Ontario family law

Family Law Matters We Help With

Family law in Ontario draws on two main statutes: the federal Divorce Act for married spouses and the provincial Family Law Act for property and support.

Divorce Act

Separation & Divorce

In Canada, the usual ground for divorce is living separate and apart for one year. We guide you through uncontested and contested divorces and the paperwork in between.

Best interests of the child

Decision-Making & Parenting Time

What used to be called custody and access is now decision-making responsibility and parenting time. We build parenting plans around your child’s best interests.

Child Support Guidelines

Child Support

Child support is set by the Federal Child Support Guidelines, based mainly on the paying parent’s income and the number of children, plus a share of special expenses.

SSAG

Spousal Support

Whether support is owed, how much and for how long depends on the length of the relationship, each person’s role and their financial needs. We use the Spousal Support Advisory Guidelines as a starting point.

Family Law Act

Property Division

Married spouses in Ontario share the growth in wealth during the marriage through an equalization of net family property, with special rules for the matrimonial home.

Out-of-court resolution

Separation Agreements & Mediation

Most families resolve their issues without a trial. We negotiate and draft binding separation agreements, and support you through mediation.

Know your rights

Married or common-law? Ontario treats you differently.

Married spouses

  1. Divorce is granted under the federal Divorce Act, usually after one year of separation.
  2. Entitled to an equalization of net family property accumulated during the marriage.
  3. Both spouses have an equal right to live in the matrimonial home until it is resolved.
  4. Strict time limits apply to property claims after separation and divorce.

Common-law partners

  1. No divorce is needed, but separation still has legal consequences.
  2. No automatic property equalization. Claims rely on ownership or trust principles.
  3. Spousal support may be owed after three years together, or sooner with a child together.
  4. Child support rights are the same for every child, whether parents married or not.

FAQ

Family Law Questions

You usually must be separated for one year before a divorce is granted. Once filed, an uncontested divorce often takes several months to process. Contested issues such as parenting or property take longer.

Not always. Many families settle parenting, support and property issues through negotiation or mediation and record the result in a separation agreement. Court is there when agreement isn’t possible.

The Federal Child Support Guidelines provide tables based on the paying parent’s income and the number of children. Special expenses, like childcare or medical costs, are usually shared in proportion to income.

For married spouses, the matrimonial home is treated specially and both spouses have a right to possession until the matter is resolved. For common-law partners, ownership on title usually matters most. Speak to a lawyer before moving out.

Agreements that keep your family out of court

Most separating couples never see a trial. We negotiate fair, enforceable separation agreements covering parenting, support and property, and support you through mediation when talks need help.
